DOLS 16-17 and Mental Capacity Act
This first part of the session will cover:
- The Mental Capacity Act 2005;
- The legal test for identifying if someone lacks mental capacity to make a decision; and
- Practical steps that should be taken if you consider someone you are working with (for example a young person or a parent/guardian) may lack mental capacity to make a decision
This second part will cover:
- What constitutes a deprivation of liberty
- When a deprivation of liberty requires the authorisation of the court;
- Options for obtaining legal authorisation of a deprivation of liberty, including applications to the High Court or the Court of Protection.
